Terms of service

Last updated

These terms are a contract between you and GehnaLab (sole proprietorship of Shubham Gautam), a sole proprietorship of Shubham Gautam trading as GehnaLab, with its office at 60 Gyan Vihar, Ajmer, Rajasthan, India (“GehnaLab”, “we”, “us”). They apply when you use gehnalab.com, our web app and any related service (together, the “Service”).

Please read them with our Privacy policy, Refund & cancellation policy, Service delivery policy and Acceptable use & AI content policy, which form part of these terms. By creating an account or buying credits you agree to all of them. If you do not agree, please do not use the Service.

1. What GehnaLab does

You upload phone photos of jewellery pieces. We use automated image systems, including generative AI, to produce catalogue images, marketplace images and on-model images (“Outputs”).

On outputs marked “Piece unchanged”, an automated check has confirmed that the pixels of your piece are identical to the pixels in your upload. Everything around the piece, such as the background, lighting, fabric and any model, is generated. The mark describes the piece region only. It is not a promise about how colours look on other screens or in print, and it does not certify the metal, purity, stones or weight of the piece.

On-model Outputs show a person who is generated by AI. They may be labelled “AI look”. That person does not exist and does not resemble any real person on purpose.

2. Who can use the Service

The Service is for businesses and professionals. To use it you must:

  • be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872;
  • use it for your trade, business or profession, such as selling or marketing jewellery; and
  • if you act for a shop, firm or company, have authority to accept these terms on its behalf. “You” then means that business as well.

You may not use the Service if we have previously suspended or closed your account for breaking these terms, or if Indian law prohibits you from using it.

3. Your account

You sign in with your mobile number and a one-time password (OTP), and you may also link a Google account. Keep your phone and Google account secure. You are responsible for everything done through your account.

Give us accurate details and keep them up to date, including your business name and GSTIN if you want GST invoices. Tell us at once at ishubham2101@gmail.com if you think someone else has accessed your account.

One person or business may hold one account unless we agree otherwise. You may not sell, transfer or share your account or credits.

4. Credits, pricing and payment

The Service runs on prepaid credits. Current prices are on our pricing page and at checkout. At the date of these terms:

  • New accounts receive free welcome credits once, enough for a small number of Looks. Welcome credits have no cash value.
  • Look pack: ₹499 for 10 Looks. Pack credits do not expire while your account is open.
  • Jeweller monthly: ₹1,499 for 30 Looks, valid for 31 days from purchase. Unused monthly credits lapse at the end of the 31 days and do not carry over. The plan does not renew automatically; you renew it when you choose.
  • Cleanup images cost about ₹12 each, paid from your credits. The exact credit cost is shown before you start a job.
  • Bulk and business plans are priced on request and may be covered by a separate written agreement.

Prices are in Indian rupees (INR) and include GST unless the checkout says otherwise. We issue a tax invoice for each purchase.

Payments are processed by Zoho Payments by UPI, debit or credit card, or net banking. We do not see or store your full card number, UPI PIN or bank login. Your bank or payment app may charge its own fees.

Credits are a prepaid right to use the Service. They are not money, a deposit, a stored-value instrument or a wallet, cannot be withdrawn as cash and cannot be transferred. Credits are used when a job is accepted for processing. If a job fails our quality checks or fails because of a fault on our side, the credits for it are returned automatically. Other refunds are covered by our Refund & cancellation policy.

We may change prices or credit costs for future purchases and jobs. Changes do not affect credits you have already bought, except that a job always costs what is shown when you start it.

5. Your uploads and your promises about them

You keep all rights you have in the photos and other material you upload (“Uploads”). By uploading, you promise that:

  • you own the jewellery pieces shown, or have the owner’s permission to photograph, market and sell them;
  • you own the photos or have the photographer’s permission to use and modify them;
  • your Uploads, and our processing of them as described in these terms, do not infringe anyone’s copyright, design, trade mark, privacy, publicity or other rights;
  • your Uploads do not show any identifiable person unless that person has given you written consent for this use, and do not show any child; and
  • your Uploads and the information you give about a piece are lawful and accurate.

If any of these promises stops being true, delete the Upload and stop using any Outputs made from it.

6. The permission you give us

You give GehnaLab a non-exclusive, royalty-free, worldwide licence to store, copy, analyse, crop, edit and transform your Uploads and Outputs, and to send them to our service providers, only as needed to provide, secure and support the Service for you. This licence ends when the Upload or Output is deleted from our systems, apart from copies we must keep by law or that remain for a short time in backups.

By default we use your images only to process your jobs (“process only”). We use them for quality review and evaluation, or to improve models on your own pieces, only if you turn on those options in your settings. You can turn them off at any time. Our Privacy policy explains each option.

We will not show your Uploads or Outputs to other customers or use them in our marketing without your separate written permission.

7. Who owns the Outputs

As between you and us, and to the extent the law allows, we assign to you any rights we have in the Outputs made for you, once the credits for them are paid. Where rights cannot be assigned, we give you a perpetual, worldwide, royalty-free licence to use, edit, publish and sell with the Outputs for any lawful purpose.

Generated material may not be protected by copyright in every country, and similar backgrounds, poses or AI models may be generated for other customers. We do not promise that you will hold exclusive rights in the generated parts of an Output.

Some sample images on our website are made from photos licensed under Creative Commons BY-SA. Those samples, and only those, are shared under the same licence. Details are on our image credits page.

8. AI content, labels and your duties when you publish

Outputs are created with generative AI. They may contain mistakes, such as odd hands, fabric or reflections, and on non-“Piece unchanged” outputs the piece itself may differ from the real one. Check every Output before you use it.

Under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended in 2026 (the “IT Rules”), AI-generated images must be identifiable as such. Our Outputs carry embedded provenance information (C2PA content credentials) and, where required, a visible AI label. When you publish or share an Output, you agree to:

  • not remove, hide, crop out, alter or strip any visible AI label, C2PA content credential or other provenance metadata, except where a platform’s own upload process does so automatically;
  • follow the AI disclosure rules of any platform or marketplace where you post, and declare that the image is AI-generated when the platform asks;
  • not present an on-model Output as a photo of a real customer, celebrity, influencer or model, or as a real person wearing the piece; and
  • describe the real piece honestly. Do not use an Output to misstate the metal, purity, hallmark, stones, size, weight or finish of a piece, and use an image that shows the piece as it really is wherever buyers rely on the image to decide.

You are responsible for the Outputs you publish and for complying with the Consumer Protection Act, 2019, the Legal Metrology and BIS hallmarking rules, advertising codes and platform rules that apply to your listings.

9. No real people, no lookalikes

Models in our on-model Outputs are original, AI-generated people. We instruct our systems not to create anyone who resembles a real person, and we reject jobs that name a real person or ask for a lookalike, such as a celebrity, influencer or public figure.

You must not try to create an image of any real person or their likeness, including by uploading a photo of a face, describing a specific person, or editing an Output to make it look like someone. If you believe an Output resembles a real person, stop using it and tell us. We will remove it and refund the credits.

10. Acceptable use

You must follow our Acceptable use & AI content policy. In short, you must not use the Service for anything unlawful, deceptive, infringing, obscene or harmful, must not attempt to break or overload it, and must not scrape, copy or reverse engineer it or use it to build a competing service or train other AI models.

We may refuse, block or delete any job, Upload or Output that we reasonably believe breaks these terms or the law, and we must act on lawful orders from courts and government agencies.

11. Our intellectual property

The Service, our software, website, Look designs, prompts, brand names and logos belong to GehnaLab or our licensors. These terms give you only the right to use the Service as described here. You may not use the GehnaLab name or logo to suggest we endorse your products without our written permission.

If you send us ideas or feedback, we may use them freely without paying you.

12. Complaints, takedown and copyright notices

If you believe content created or stored through the Service infringes your rights, shows you without consent, or is otherwise unlawful, contact our Grievance Officer as set out on our Grievance redressal page. Include your contact details, the content concerned, the right you say is affected and a statement that your complaint is made in good faith.

We will acknowledge complaints within 24 hours and act within the timelines set by the Information Technology Act, 2000 and the IT Rules. We may remove or disable content and suspend accounts while we look into a complaint. If we remove your content, we will tell you why where the law allows, and you may reply.

13. Service availability and changes

We work to keep the Service running, but it is provided over the internet and depends on third-party AI, cloud and payment providers. We do not promise it will always be available, uninterrupted, error-free or fast. We may pause it for maintenance, security or reasons outside our control.

We may add, change or remove features and Looks. If we stop offering the Service entirely, we will give you at least 30 days’ notice where we reasonably can, let you download your Outputs, and refund the value of unused paid credits.

Keep your own copies of Outputs you need. We are not a backup service.

14. Disclaimers and limits on our liability

Apart from the promises we make expressly in these terms, the Service and Outputs are provided “as is” and “as available”. To the extent the law allows, we exclude all implied warranties, including fitness for a particular purpose and that Outputs will meet your needs, be accepted by any marketplace, or produce sales.

To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data, even if it was foreseeable.

Our total liability to you for all claims arising out of or relating to the Service or these terms is limited to the amount you paid us in the three months before the event that gave rise to the claim.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or any other liability that cannot be limited under Indian law.

15. Your responsibility to us

You will compensate GehnaLab, its owners, employees and service providers for any loss, damage, penalty and reasonable legal costs arising from a claim by a third party or a regulator that results from your Uploads, your breach of these terms or the law, your listings or advertisements, or your use of Outputs. We will tell you promptly about any such claim and let you take part in its defence.

16. Suspension and closing your account

You may stop using the Service and ask us to close your account at any time from your settings or by writing to ishubham2101@gmail.com.

We may suspend or close your account, with notice where practical, if you seriously or repeatedly break these terms, if the law or a lawful order requires it, or to protect the Service or other people. If we close your account without fault on your part, we will refund unused paid credits.

When an account is closed, unused credits lapse except as stated above or in our Refund & cancellation policy, and we delete your data as described in our Privacy policy. Sections 5 to 9 and 11 to 18 continue to apply after closure.

17. Governing law and disputes

These terms are governed by the laws of India.

If you have a problem, please write to us first at ishubham2101@gmail.com or use our Grievance redressal process. Most issues can be sorted out that way.

If a dispute is not resolved within 30 days of written notice, either party may refer it to arbitration by a sole arbitrator appointed by mutual agreement under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Ajmer, Rajasthan, India, and the language will be English. Either party may seek urgent interim relief from a court.

Subject to arbitration, the courts at Ajmer, Rajasthan, India have exclusive jurisdiction. Nothing here takes away any right you have under law that cannot be waived by contract, including any right to approach a consumer commission where the law allows it.

18. General

We may update these terms from time to time. We will post the new version here with a new date, and for important changes we will tell you by email, SMS or in the app at least 7 days before they take effect. If you keep using the Service after that, the new terms apply. If you do not agree, you may close your account and receive a refund of unused paid credits.

If any part of these terms is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we have not given it up. You may not transfer these terms to anyone else without our consent. We may transfer them to a business that takes over the Service, and will tell you if we do.

These terms, with the policies linked above, are the whole agreement between us about the Service. If you have a separate signed agreement with us, it takes priority where it conflicts.
